This Refund Policy (hereinafter the "Policy") sets out the criteria and procedures for cancellations and refunds of the paid services provided by Software Creation Studio (hereinafter the "Company").
Article 1 (Scope of Application)
- This Policy applies equally regardless of the country of use, payment currency or payment gateway provider.
- The subscription refund criteria in this Policy apply to PolyBot and PolyGlot subscriptions. Services provided under individual contracts, such as ERP, web or app development, are governed by the conditions set out in the relevant contract, and where a separate service level agreement (SLA) has been concluded, that agreement applies.
- This Policy does not limit the mandatory provisions applicable to users under Articles 3 and 18 of the Terms of Service, or any individual agreement that is more favorable to users.
Article 2 (Types of Cancellation and Refund)
- Withdrawal: The user's withdrawal from the contract within the period and under the requirements set out in Article 11 of the Terms of Service. The refund amount is governed by applicable law.
- Standard cancellation: The user's cancellation of a subscription before the next billing cycle begins, in accordance with Article 10 of the Terms of Service. Fees already paid for the current cycle are not refunded.
- Early cancellation: The user's immediate termination of use during the service period with a refund of the fees for the remaining period, as set out in Article 3.
- Membership withdrawal: Where a user requests to withdraw their membership under Article 15 of the Terms of Service, the Company treats any ongoing subscription as an early cancellation and issues a refund in accordance with Article 3.
Article 3 (Refunds for Early Cancellation)
- If the user requests an early cancellation before the date the Services become available for use (hereinafter the "service availability date"), the Company refunds the full amount paid.
- On or after the service availability date, the Company refunds the amount calculated as the actual amount paid for the relevant payment (including tax) × unused days ÷ total days of the service period. Annual subscriptions are also calculated based on the amount actually paid.
- The total days of the service period are the number of days in the period available under the relevant payment, and the unused days are the number of days from the date the early cancellation request is received to the last day of that period.
- Any fraction of the calculated amount smaller than the minimum unit of the payment currency is rounded up.
- Once an early cancellation request has been processed, use of the Services under that subscription ends.
Article 4 (Refunds for Reasons Attributable to the Company)
- Where the Company fails to provide the Services, or provides them differently from the contract, for reasons attributable to the Company, users may request a refund in accordance with applicable law, regardless of the withdrawal period or the calculation method in Article 3.
- Matters concerning compensation for damages are governed by Article 12 of the Terms of Service.
Article 5 (How to Make a Request)
- Users may request a withdrawal, standard cancellation or early cancellation by email (sales@softwarecreation.studio).
- To verify a request, the Company may ask for information needed to identify the contract, such as the member email address and the service name.
- A withdrawal may be made by expressing the intention to withdraw within the period set out in Article 11 of the Terms of Service, and the Company does not require any particular form.
Article 6 (Processing of Refunds)
- The Company cancels the payment or refunds the amount through the original payment method within 3 business days from the date the withdrawal or refund request is received.
- For payments made by credit card or similar means, the Company requests cancellation through the payment gateway provider, and the time at which the cancellation is reflected in the payment history may vary depending on the processing schedules of card issuers and other payment institutions.
- Where a refund cannot be made through the original payment method, the Company refunds the amount by a method agreed with the user and does not charge any separate refund fee.
Article 7 (Refunds of Overcharges)
Where fees have been charged in error, such as through a duplicate payment, the Company refunds the full amount charged in error in accordance with Article 6.
Article 8 (Relationship with Other Policies)
- Matters not set out in this Policy are governed by the Terms of Service and applicable law.
- Matters concerning the processing of personal information and the retention of transaction records in the course of handling refunds are governed by the Privacy Policy.
Article 9 (Changes to This Policy)
Changes to this Policy and notice of such changes are governed by Article 2 of the Terms of Service.
